Wareham ZBA closes hearing, delays 40B vote

Wareham Zoning Board closes 40B hearing on 4 West Street, but balks at an immediate vote. The board voted 5-0 to close the continued public hearing after peer-review engineer Phil Codero of Allen Major Associates reported the applicant had resolved septic, drainage and fire-circulation concerns, including a reconfigured drain field now meeting the state's 50-foot wetland separation standard. Chair Nazih Elkallassi moved to grant the comprehensive permit outright but withdrew the motion after Codero advised the board to instead issue a full written decision with conditions, as state law allows 40 days from the close of the hearing.
Elkallassi noted the project predates Wareham's new 40B "safe harbor" status, saying, "were this to come in front of me now, I would vote against it." Director of Planning Joshua Faherty was told to place the decision on the October 28 agenda, inside the roughly November 2 statutory deadline.
